HOLLISTER EQUIPMENT RENTALS — RENTAL AGREEMENT & LIABILITY WAIVER

This Equipment Rental Agreement ("Agreement") is between Hollister Equipment Rentals, a division of Hollister Property Management, 1415 S Monroe Ave, Mason City, Iowa ("Company") and the undersigned customer ("Renter").

I. RENTAL TERMS

Renter agrees to rent equipment for the period and at the rates confirmed at booking. All rental fees not covered by the deposit are due when Renter takes possession of the equipment.

II. SECURITY DEPOSIT

A 20% security deposit on a credit card is required to confirm reservations. The deposit is fully refundable after equipment is returned and inspected with no damage beyond normal wear and tear. The remaining balance is due at the start of the rental period. If paying the balance in cash, the credit card deposit is still required.

III. ASSUMPTION OF RISK

Renter acknowledges that the operation of heavy equipment, including mini skid steers and all attachments, involves inherent risks of property damage, personal injury, or death. Renter voluntarily assumes all such risks.

IV. RELEASE OF LIABILITY

To the fullest extent permitted by Iowa law, Renter releases, waives, and covenants not to sue Hollister Equipment Rentals, Hollister Property Management, its owners, officers, employees, and agents ("Releasees") from any and all liability, claims, or causes of action arising from any loss, damage, injury, or death resulting from use of the equipment, whether caused by negligence of the Releasees or otherwise.

V. INDEMNIFICATION

Renter agrees to defend, indemnify, and hold harmless the Releasees from any and all claims, damages, losses, and expenses (including attorney's fees) arising from Renter's use, operation, or possession of the equipment.

VI. EQUIPMENT RESPONSIBILITY

Renter is responsible for the equipment from delivery or pickup until return. Renter is liable for all damage beyond normal wear and tear, theft, vandalism, or loss during the rental period regardless of cause.

VII. PROPER USE & OPERATOR QUALIFICATIONS

Renter agrees to use equipment only for its intended, lawful purpose per manufacturer guidelines. Equipment shall not be operated by unqualified individuals. Renter shall not sublet or loan the equipment to third parties.

VIII. INSURANCE

Renter is solely responsible for maintaining appropriate insurance during the rental period, including damage, theft, and third-party liability coverage. The Company's insurance does not extend to Renter's operations while the equipment is in Renter's possession.

IX. CUSTOMER PICKUP

If Renter elects to haul the equipment using their own tow vehicle, Renter warrants that the vehicle has adequate towing capacity and is covered by valid insurance. Renter assumes full liability for any damage or incident during transport. Company will assist with loading and securing the equipment.

X. RETURN CONDITION

Equipment must be returned in the same condition as received, with fuel tank full. Renter is responsible for cleaning fees if equipment is returned excessively dirty beyond normal use.

XI. CANCELLATION POLICY

Cancellations must be made at least 5 days (120 hours) before the scheduled start date to receive a full refund of the deposit. Cancellations made less than 5 days in advance forfeit the deposit. To cancel: call (641) 425-3745 or email [email protected].

XII. GOVERNING LAW

This Agreement is governed by the laws of the State of Iowa. Any disputes shall be resolved in the courts of Cerro Gordo County, Iowa.

XIII. ACKNOWLEDGMENT

By checking the box below, Renter confirms they have read, understand, and voluntarily agree to all terms. This digital acceptance constitutes a binding signature under Iowa law.
